1. Introduction
Welcome to Proyecto 26. These Terms & Conditions govern your use of our website (proyecto26.com) and our open source software projects hosted on GitHub. By using our services, you agree to comply with and be bound by these terms. If you disagree with any part of these terms, please do not use our website or projects. Please note that different materials are subject to different licenses: our source code is distributed under permissive open source licenses, while our media assets (images, audio, game artwork, and other creative content) are protected under a separate Creative Commons license. 2. Definitions
"Source Code" refers to the software code, configuration files, and technical documentation in our GitHub repositories and this website's codebase. "Media Assets" refers to images, illustrations, audio files, game artwork and sprites (including NinjaDev assets), logos, brand materials, and other creative content published on this website or included in our repositories. "Projects" refers to the open source software libraries, tools, and applications maintained by Proyecto 26. "Website" refers to proyecto26.com and all its subdomains.
3. Source Code License (MIT)
Our open source projects and the website's source code are distributed under the MIT License (or similar permissive licenses as specified in each repository). 4. Media Assets License (CC BY-NC-ND 4.0)
The media assets on this website — including images, photographs, illustrations, SVG icons, audio files, video files, game artwork and sprites (including NinjaDev assets), logos, brand materials, documentation screenshots, diagrams, CSS animations, and other creative content located in directories such as /public/img/, /src/assets/, and similar asset directories — are licensed under the Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 International License (CC BY-NC-ND 4.0). Source code files (.js, .ts, .astro, .css, .html, and configuration files) are explicitly excluded from this license and are covered by the MIT License in Section 3. This means you may share and redistribute these assets in any medium or format under the following conditions: you must give appropriate credit to Proyecto 26, provide a link to the license, and indicate if changes were made; you may not use the assets for commercial purposes; and you may not distribute modified or adapted versions of these assets. 5. Trademarks and Branding
The Proyecto 26 name, logo, and brand identity are proprietary and are not covered by either the MIT License or the CC BY-NC-ND 4.0 License. The right to use our open source software does not include the right to use our project names, logos, or brand materials. You may not use our trademarks, logos, or brand elements in a manner that suggests endorsement, affiliation, or sponsorship without prior written consent. Nominative fair use is permitted solely to identify Proyecto 26 as the source of the software (e.g., linking to our projects or crediting contributions in documentation).
6. Contributions
We welcome contributions to our open source projects. By submitting a pull request, issue, or other contribution to any Proyecto 26 repository, you agree that your contribution will be licensed under the same license as the project you are contributing to (typically MIT). You represent that you have the right to grant this license and that your contribution does not infringe any third-party rights. Contributors retain copyright to their individual contributions. We use the Developer Certificate of Origin (DCO). By adding a 'Signed-off-by' line to your commits (using `git commit -s`), you certify that you have the right to submit the contribution under the project's license. 7. Community Platform & Discord
Proyecto 26 operates a Discord community server and bot ("Proyecto 26 Bot") to facilitate community discussion, sponsor support, and project coordination. By joining our Discord server, you agree to abide by our Code of Conduct and Discord's own Terms of Service. The Proyecto 26 Bot is used solely for server management, announcements, and sponsor support automation — it does not collect personal data beyond what Discord provides. Certain channels (such as sponsor support and sponsor chat) are restricted to verified sponsors at the applicable tier level. We reserve the right to remove users from the Discord server who violate our Code of Conduct or these Terms. Access to private sponsor channels is contingent upon active sponsorship status; if your sponsorship ends, access to sponsor-only channels may be revoked. Proyecto 26 is not responsible for content posted by community members in the Discord server.
8. Disclaimer of Warranties
The materials on Proyecto 26's website and repositories are provided on an 'as is' basis. Proyecto 26 makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Proyecto 26 does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
9. Limitation of Liability
In no event shall Proyecto 26 or its contributors be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Proyecto 26's website or open source projects, even if Proyecto 26 or an authorized representative has been notified orally or in writing of the possibility of such damage. 13. Indemnification

This indemnification obligation will survive the termination of these Terms and your use of the website and projects.
14. Termination
We may terminate or suspend your access to our website and services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms & Conditions. Upon termination, your right to use the website will immediately cease. However, the following sections shall survive termination: Section 3 (Source Code License), Section 4 (Media Assets License), Section 5 (Trademarks and Branding), Section 8 (Disclaimer of Warranties), Section 9 (Limitation of Liability), Section 13 (Indemnification), Section 16 (Governing Law), and any other provisions that by their nature should survive. Termination of access to the website does not affect any rights granted under applicable open source licenses for code you have already obtained, as those licenses are irrevocable (subject to their own terms).
15. Force Majeure
Proyecto 26 shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, epidemics or pandemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, accidents, strikes or labor disputes, power or telecommunications failures, internet service provider failures, government actions or orders, cyberattacks, or any other force majeure event. During such events, Proyecto 26's obligations under these Terms will be suspended for the duration of the force majeure event. We will make reasonable efforts to notify users of any such event and its expected duration.
16. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Colombia, and you irrevocably submit to the exclusive jurisdiction of the courts in that location. Any disputes arising from the use of our open source projects shall first be attempted to be resolved through the project's GitHub issue tracker. If a dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing litigation. Nothing in these Terms shall limit or exclude any rights you may have under mandatory consumer protection laws in your jurisdiction, including but not limited to the Colombian Consumer Protection Statute (Law 1480 of 2011) or equivalent laws in your country of residence, which may provide additional rights that cannot be waived by contract.
